The Betting Scenario in Brazilian Football: What’s Going On?

In the coming days, football clubs, betting houses, and the associations that represent these entities will intensify their efforts to reverse the provisional measure that suspended betting operations in Brazil. This battle will play out on multiple fronts, with objectives ranging from the immediate to long-term plans.

Discontent in the Air

The mood among clubs and betting houses is one of total dissatisfaction! Everyone is expecting that, at the very least, it will be possible to minimize the damage caused by this measure in the short term. Meanwhile, on the Federal Government’s side, the message has been clear: this decision seems irreversible.

The Judicial Path

The first front is in the legal arena, where the expectation is that actions already underway in the Brazilian Federal Supreme Court (STF) will gain momentum. There was an idea to open cases in different courts, but now the bet is to concentrate the discussion on the actions that were already filed with the Court, under the rapporteurship of Justice Luiz Fux.

  • New direct actions of unconstitutionality have been filed, such as the ADI 8024 brought by ANSEJA (National Association for Legal Security in Games and Bets) and the ADI 8027 brought by ANJL (National Association of Games and Lotteries).
  • In addition, new petitions from sector entities are being added to actions that had already been pending since the regulation of betting.

Flamengo is the only club that, so far, has entered the ADI 8027 as an “amicus curiae,” meaning it is not the author of the action, but wants to present its arguments as an interested party in the case. Other teams are considering the same strategy.

Initial Objective: Suspending the Provisional Measure

The actions in the STF initially focus on suspending the provisional measure through an injunction. In this way, betting could continue to operate while the discussion deepens and the Judiciary reaches a final ruling.

Attempts to Talk with the Government

Another front is communication between clubs and the Federal Government through the Ministry of Sports, which, for now, is at a standstill. To show their dissatisfaction with the new measure, the clubs even canceled a meeting scheduled with the Ministry due to low participation.

  • But representatives of Série A teams facing financial distress acknowledge that this situation could change if a concrete proposal for financial help appears.

The government, for its part, talks about a national restructuring program for soccer, with funding that could reach 20 years, including labor debts and taxes. But, so far, everything is only in general terms, with no concrete plan.

Paralysis: An Unlikely Scenario

The idea of stopping the Brazilian championships seems unlikely for a number of reasons. First, it would severely affect clubs’ revenues, which are highly dependent. Second, it could alienate the CBF, an entity that is also seen as an ally in future negotiations in Brasília.

In addition, there is already an initial conversation among some clubs about negotiating a period of leniency regarding the rules of financial fair play due to the betting situation. But nothing has been formalized yet.

Eyes on the Legislature: The Future of the Betting Market

As for the legislative situation, betting has certainty that the future of the market will be decided there. The Provisional Measure is valid for 60 days and can be extended by another 60, but it must be voted on and approved by the Congress and the Senate.

Meanwhile, it will be a period of intense work by companies, with the support of most clubs, to seek legislative backing and try to change public perception about betting. Immediate actions are seen as stopgap measures to keep the industry active until a final decision is reached.

At present, there are already eleven proposals to amend the MP that bans betting. Some future ideas include the legalization of sports betting, but with restrictions, such as prohibiting online casinos and policies to combat gambling addiction.

This is the situation that clubs and betting houses are in right now. In the meantime, some teams are trying to negotiate with betting houses to suspend contracts instead of completely terminating them. Flamengo, for example, succeeded in this negotiation with Betano, but others, like Vitória, have already seen their contracts terminated.

The fight is only just beginning, and we’ll be closely following this saga!
